These terms and conditions govern your use of the website at fluxfunding.co.uk and the credit broking service we provide. Please read them carefully before using our website or applying through us. By accessing our website or submitting an application, you confirm that you accept these terms and conditions and that you agree to comply with them.
1. Who we are
Flux Funding Limited ("Flux Funding", "we", "us" or "our") is a credit broker, not a lender. We are a company registered in England and Wales under company number 10985517, with our registered office at Newgate House, Newgate Street, Chester, CH1 1DE.
Flux Funding Limited is authorised and regulated by the Financial Conduct Authority. Our Firm Reference Number (FRN) is 806333. You can verify our authorisation on the Financial Services Register at register.fca.org.uk.
We operate a number of consumer brands, including PaydayUK, Sunny, The Money Shop and New Horizons. References in these terms to "our website" include any website we operate under these brands.
2. Your acceptance of these terms and conditions
By using our website and our service you confirm that you accept these terms and conditions and agree to be bound by them. If you do not agree to these terms and conditions, you must not use our website or submit an application through us.
Our service is available only to individuals who are UK residents, aged 18 years or over, and who are using our website for their own personal, non-commercial purposes. By using our service you warrant that you meet these requirements.
3. Changes to these terms and conditions
We may revise these terms and conditions at any time by amending this page. Any changes take effect from the date they are posted on our website. Please check this page from time to time to take notice of any changes we have made, as they are binding on you. 4. The Flux Funding service
Flux Funding is a credit broker, not a lender. We provide an online credit broking service that helps you search for and apply for loans and related products offered by third-party lenders on our panel. We introduce and match applicants to these lenders based on the information you provide.
We do not make lending decisions and we do not lend money ourselves. The decision whether to offer you a loan, and the terms of any loan, rests entirely with the lender you are matched with. We do not guarantee that you will be matched with a lender, that any loan will be offered, or that any application will be accepted.
When you apply through us, we carry out an affordability assessment only, based on the information you supply. We do not carry out credit-bureau checks, identity verification or fraud screening ourselves. The lender you are matched with may carry out its own checks, including credit reference, identity and fraud checks, and makes the final lending decision.
We do not charge you a fee for using our service. As a credit broker, we receive a commission or fee from the lender for introducing you to them. The amount of commission we receive may vary depending on the lender and the product. The receipt of this commission does not affect the amount you pay to the lender. 5. Your use of our website
Our website is for your personal use only. You agree that you will not use our website or our service in any unlawful or fraudulent manner, or for any purpose that is harmful, unlawful or otherwise objectionable. In particular, you must not:
- use our website in any way that breaches any applicable local, national or international law or regulation;
- provide information that is false, inaccurate, incomplete or misleading, or impersonate any other person;
- use our website to transmit any unsolicited or unauthorised advertising or promotional material;
- attempt to gain unauthorised access to our website, the server on which it is stored, or any server, computer or database connected to it.
6. Your obligations and warranties
You warrant that all information you provide to us is true, accurate, current and complete in all respects, and that you will keep it up to date. The quality of the introductions we are able to make, and the affordability assessment we carry out, depends on the accuracy of the information you give us. We are not responsible for any loss arising from information you have provided that is inaccurate, incomplete or misleading.
7. Communications from or on behalf of Flux Funding
When you submit an application through us, you agree that we, our brands and the lenders we introduce you to may contact you about your application by email, telephone, SMS or post. We will only contact you for marketing purposes where you have given us permission to do so, and you may withdraw that permission at any time. 8. Affordability assessment, credit checks and references
The assessment we carry out is an affordability assessment only, based on the information you provide. We do not carry out credit-bureau checks, identity verification or fraud screening when you use our website. The lender to whom we introduce you may carry out a credit check and other searches, including identity and fraud checks, and will be responsible for its own assessment and lending decision. You should refer to the lender's own terms for details of the checks it carries out.
9. Intellectual property rights
We are the owner or the licensee of all intellectual property rights in our website and in the material published on it. All rights in fluxfunding.co.uk and in our brand names, logos and content are owned by or licensed to us and are protected by copyright, trade mark and other laws.
You may view, download and print extracts of our website for your own personal use, but you must not modify, copy, reproduce, republish, distribute or commercially exploit any part of our website without our prior written permission.
10. Third party websites and links from our website
Our website may contain links to websites and resources operated by third parties, including the lenders we introduce you to. These links are provided for your information only. We have no control over the contents of those sites or resources and accept no responsibility for them, or for any loss or damage that may arise from your use of them. The inclusion of a link does not imply any endorsement by us of that site or its operator. Any dealings you have with a third party are between you and that third party, and are subject to that third party's own terms and conditions.

We process information about you in accordance with our Privacy Policy. By using our website and our service you consent to such processing and you warrant that all data provided by you is accurate. - any decision by a lender whether or not to offer you a loan, or the terms on which it does so;
- the suitability of any loan or product offered to you by a lender;
- the acts or omissions of any lender or other third party to whom we introduce you;
- any unavailability of our website, or any errors or omissions in its content, for reasons beyond our reasonable control.
We will not be liable for any loss of profits, loss of business, or any indirect or consequential loss. We provide our website on an "as is" basis and make no representations or warranties of any kind, express or implied, in relation to it, except as expressly set out in these terms.
14. Viruses, hacking and other offences
You must not misuse our website by knowingly introducing viruses, trojans, worms or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our website, the server on which it is stored, or any server, computer or database connected to it. We will report any such breach to the relevant law enforcement authorities and co-operate with them, and your right to use our website will cease immediately.

These terms and conditions, their subject matter and their formation are governed by the law of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms and conditions or their subject matter.
